Acceptance of Terms

By accessing or using the website located at indioasphaltpaving.com, or by requesting services from Indio Asphalt Paving ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services. We may update these terms at any time, and your continued use of our website or services after any update constitutes acceptance of the revised terms.

Description of Services

Indio Asphalt Paving provides asphalt paving, sealcoating, repair, and related pavement services to residential and commercial customers in the Coachella Valley and surrounding areas. Services are performed by our team or by qualified subcontractors acting under our direction. We reserve the right to decline or discontinue any project at our discretion, including projects that present unsafe conditions or that fall outside our scope of service.

Estimates and Pricing

All estimates are provided in writing and are based on conditions observed at the time of assessment. An estimate is not a final contract until both parties have signed a written service agreement. Prices may change if:

• Site conditions differ materially from what was observed at estimate time.
• The scope of work changes at the customer's request.
• Material costs increase between estimate and project start date.
• Unforeseen conditions such as unstable base material, buried obstructions, or drainage issues are discovered during work.

We will notify you promptly if the project scope or cost needs to change before proceeding with additional work.

Scheduling and Cancellation

Once a project is scheduled, we commit resources and equipment in advance. Please provide at least 48 hours notice if you need to cancel or reschedule. We understand that circumstances change, and we will do our best to accommodate schedule adjustments.

We reserve the right to reschedule work due to weather conditions, equipment issues, or safety concerns. In such cases, we will contact you as early as possible to arrange an alternative date. No charges will apply for company-initiated rescheduling.

Payment Terms

Payment terms are outlined in the written service agreement for each project. In general:

• A deposit may be required before work begins on larger projects, as specified in your service agreement.
• Final payment is due upon project completion unless otherwise agreed in writing.
• Accepted payment methods will be communicated at the time of your agreement.
• Invoices not paid within the agreed timeframe may be subject to a late fee as described in your service agreement.

Disputes about invoices must be raised in writing within 5 business days of receipt. We will work in good faith to resolve any billing concerns promptly.

Warranty and Workmanship

We stand behind the quality of our work. Any warranty coverage applicable to your project will be specified in your written service agreement. Warranty coverage is subject to the following limitations:

• Warranties apply to defects in materials and workmanship under normal use conditions.
• Warranty coverage does not apply to damage caused by extreme weather events, flooding, tree root intrusion, or changes in the underlying ground conditions after project completion.
• Warranty coverage does not apply if the customer has made modifications to the work or failed to follow any post-installation care instructions provided at project completion.
• Sealcoating and maintenance services are not covered by the same warranty as structural paving work - specific coverage for each service type will be outlined in your agreement.

Limitation of Liability

To the fullest extent permitted by applicable law, Indio Asphalt Paving will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from our services will not exceed the amount you paid to us for the specific project giving rise to that claim.

Disclaimer of Warranties

The content on this website is provided for informational purposes only. We make no representations or warranties that the website will be available without interruption, error-free, or free of viruses or other harmful components. All information on this website is provided "as is" without warranty of any kind, express or implied, except as explicitly stated in a written service agreement for a specific project.

Customer Responsibilities

To help us complete your project safely and on time, you agree to:

• Provide accurate information about the project site and any known conditions that might affect our work.
• Ensure the work area is accessible and clear of vehicles, equipment, and personal property on the scheduled work date.
• Obtain any required HOA approvals or permits if your property is subject to association rules, unless otherwise agreed in your service contract.
• Follow any post-installation care instructions we provide, including curing times before driving on fresh asphalt.

Intellectual Property

All content on this website - including text, images, logos, and design - is the property of Indio Asphalt Paving or its content providers and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or use any content from this website without our prior written permission.

Dispute Resolution

If a dispute arises between you and Indio Asphalt Paving relating to our services, we encourage you to contact us first so we can try to resolve the matter directly. If we cannot reach a resolution through good-faith discussion, disputes will be resolved through binding arbitration in Indio, CA, under the rules of the American Arbitration Association, unless both parties agree in writing to another resolution method. Nothing in these terms prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

Governing Law

These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising under these terms that is not resolved through arbitration will be brought in a court of competent jurisdiction in California.

Modifications to These Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with a revised Effective Date. If you have an active service agreement with us, changes to these general terms will not affect that agreement unless both parties agree in writing. For website use, your continued use of the site after any changes constitutes acceptance of the updated terms.
